Terms of Service

In short

You keep every right to the music you upload. We store it and show it to whoever you choose, and that is the whole of our claim to it.

Pay for your plan, do not store things you have no right to store, and do not attack the service. That is most of what is asked of you.

You can leave at any time and take everything with you.

Agreement

These terms apply between you and Northwest Falls when you create an account or use the service. If you do not accept them, do not use the service.

If you are using Northwest Falls on behalf of a company or a label, you confirm you are allowed to accept these terms for that organisation.

Your account

You need a working email address and you must be at least 16, or the age of digital consent where you live if that is higher.

You are responsible for what happens under your account. Keep your password to yourself, and tell us at security@northwestfalls.com if you think someone else has it.

One person, one account. Sharing a login is how catalogues get deleted by mistake. If more than one person needs access, add them as collaborators.

What you may store

Music you made, music you have rights to, and the material that goes with it. Acceptable Use lists what you may not store.

Northwest Falls is for music and the work around it. It is not general file storage and not a content delivery network for unrelated material.

Who owns what

You own everything you upload. Uploading does not transfer, assign, or license your rights to us beyond what is needed to run the service.

To operate, we need permission to store your files, make the copies required to play them back, generate waveforms and thumbnails, and show them to the people you choose. That permission covers nothing else. It ends when you delete the file. Your content sets this out in full.

We do not use your music to train anything, do not license it to anyone, and do not make it public.

Plans and payment

Plans are billed monthly or yearly in advance. Prices are shown on the pricing page and include VAT where it applies.

Payments are handled by our merchant of record, who is the seller of record for your purchase and handles tax. We never receive your card number.

Upgrading takes effect immediately and you are charged the difference for the rest of the period. Downgrading takes effect at the end of the period you have paid for. Refund Policy covers money back.

If a payment fails we will retry and email you. If it keeps failing, the account moves to a paused state. A paused account is read only. Nothing is deleted.

Storage limits

Each plan includes an amount of storage. We email you at 85 percent of it.

Going over the limit stops new uploads. Everything already stored stays exactly where it is, stays playable, and stays downloadable. We do not delete files to enforce a quota.

Ending the arrangement

You can cancel at any time from your settings. Your plan runs until the end of the period you have paid for, and after that the account becomes read only.

We keep your files for 90 days after an account goes read only. Export is available for that whole period. After 90 days, and only after we have emailed you at least twice, the files may be removed.

We may suspend an account that breaches Acceptable Use, that we are legally required to suspend, or that is being used to attack the service. Except where the law prevents it, we will tell you why and give you a way to respond and to export.

Availability

We aim for the service to be available continuously and we publish live status at status.northwestfalls.com. We do not promise it will never be interrupted.

Being able to reach your files is the point of the product, so if we ever wind the service down we commit to at least 90 days of notice with export open the entire time.

Liability

The service is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability in any 12 month period is limited to what you paid us in that period.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer in the EU or the UK, your statutory rights are unaffected.

Keep your own backup. We take care of your files and we would rather say this plainly than have you learn it the hard way: no single copy of anything, anywhere, is a backup.

Changes

We may change these terms. For anything that materially affects you we will email you at least 30 days beforehand. Continuing to use the service after a change means you accept it, and if you do not, you can cancel and export.

Law

These terms are governed by the law of the European Union member state in which Northwest Falls is established, and the courts there have jurisdiction. If you are a consumer, you may also bring a claim in the courts where you live.
